BNS Section 45 — Abetment of a thing
CHAPTER IV OF ABETMENT, CRIMINAL CONSPIRACY AND ATTEMPT — of abetment
Criminal
Summary
A person abets the doing of a thing when they do any of the following: (a) instigate any person to do that thing; or (b) engage with one or more other persons in a conspiracy for the doing of that thing, provided that an act or illegal omission actually takes place in pursuance of that conspiracy and in order to do that thing; or (c) intentionally aid the doing of that thing by any act or illegal omission.
Explanation 1 clarifies what counts as instigation. A person is said to instigate the doing of a thing if, by wilful misrepresentation, or by wilful concealment of a material fact that they are bound to disclose, they voluntarily cause or procure, or attempt to cause or procure, that thing to be done. The illustration given is of a public officer authorised by a court warrant to apprehend Z, where another person, knowing that fact and also knowing that C is not Z, wilfully represents to the officer that C is Z, thereby intentionally causing the officer to apprehend C. In that case, the person abets by instigation the apprehension of C.
Explanation 2 clarifies what counts as aiding. Whoever, either before or at the time of the commission of an act, does anything in order to facilitate the commission of that act, and thereby actually facilitates its commission, is said to aid the doing of that act.
