BNS Section 60 — Concealing design to commit offence punishable with imprisonment
CHAPTER IV OF ABETMENT, CRIMINAL CONSPIRACY AND ATTEMPT — of abetment
Criminal
Summary
This section deals with a person who hides a plan to commit an offence that is punishable with imprisonment. The person must act with the intention of helping the offence happen, or with the knowledge that hiding the plan is likely to help it happen. The hiding must be done voluntarily, either through some act or through an illegal omission, and it involves concealing the existence of the plan or making a false representation about the plan that the person knows to be untrue.
If the offence is actually committed, the person who concealed the plan is punished with imprisonment of the same kind as provided for that offence, but the term of imprisonment can extend only up to one-fourth of the longest term prescribed for the offence.
If the offence is not committed, the punishment is imprisonment for a term that can extend up to one-eighth of the longest term prescribed for the offence, or a fine as provided for the offence, or both.
