BNSS Section 236 — When manner of committing offence must be stated
CHAPTER XVIII THE CHARGE — A.—Form of charges
Criminal
Summary
If the basic details of the charge do not give the accused enough information about what they are accused of, the charge must include a description of how the offence was committed. For example, if someone is charged with cheating, the charge must explain the specific way they cheated. But if someone is charged with theft or murder, the charge does not need to describe how the theft or murder was carried out.
Official Text
When the nature of the case is such that the particulars mentioned in sections 234 and 235 do not give the accused sufficient notice of the matter with which he is charged, the charge shall also contain such particulars of the manner in which the alleged offence was committed as will be sufficient for that purpose.
