BNSS Section 453 — Execution of order passed under section 409

Summary

When a death sentence case is sent to the High Court for approval, and the trial court (Court of Session) gets back the High Court's order—whether it confirms the sentence or gives a different order—the trial court must carry out that order. It does this by issuing a warrant or taking any other steps needed to put the order into effect.

Official Text

When in a case submitted to the High Court for the confirmation of a sentence of death, the Court of Session receives the order of confirmation or other order of the High Court thereon, it shall cause such order to be carried into effect by issuing a warrant or taking such other steps as may be necessary.
