BSA Section 160 — Former statements of witness may be proved to corroborate later testimony as to same fact

Summary

A witness's earlier statement can be used in court to support or back up the witness's later testimony, but only if the earlier statement relates to the same fact. The earlier statement must have been made either around the time the fact actually happened, or before any authority that was legally allowed to investigate that fact. Such an earlier statement may be proved in court for this purpose.

In order to corroborate the testimony of a witness, any former statement made by such witness relating to the same fact, at or about the time when the fact took place, or before any authority legally competent to investigate the fact, may be proved.
