BSA Section 166 — Giving, as evidence, of document called for and produced on notice

Summary

When a party asks for a document and has already given the other side formal notice to produce it, and that document is then brought forward and inspected by the party who asked for it, that party must present the document as evidence if the side that produced it asks for it to be used in the case.

When a party calls for a document which he has given the other party notice to produce, and such document is produced and inspected by the party calling for its production, he is bound to give it as evidence if the party producing it requires him to do so.
