CPC Section 108 — Procedure in appeals from appellate decrees and orders

Civil

Summary

The rules for appeals from original court decisions also apply, as much as possible, to appeals from decisions made by a higher court on appeal, and to appeals from certain court orders. This includes orders made under this Code or under any special or local law, as long as that law does not already have its own different procedure for such appeals.

The provisions of this Part relating to appeals from original decrees shall, so far as may be, apply to appeals—

(a) from appellate decrees, and

(b) from orders made under this Code or under any special or local law in which a different procedure is not provided.
