CPC Section 19 — Suits for compensation for wrongs to person or movables

Summary
If a lawsuit is for compensation for harm done to a person or to movable property, and the harm happened in the area of one court while the person being sued lives, runs a business, or works for income in the area of another court, the person filing the suit can choose to file it in either court. For example, if someone living in Delhi beats another person in Calcutta, the victim can sue either in Calcutta or in Delhi. Similarly, if someone living in Delhi publishes defamatory statements about another person in Calcutta, that person can sue either in Calcutta or in Delhi.

Where a suit is for compensation for wrong done to the person or to movable property, if the wrong was done within the local limits of the jurisdiction of one Court and the defendant resides, or carries on business, or personally works for gain, within the local limits of the jurisdiction of another Court, the suit may be instituted at the option of the plaintiff in either of the said Courts. Illustrations
(a) A, residing in Delhi, beats B in Calcutta. B may sue A either in Calcutta or in Delhi.
(b) A, residing in Delhi, publishes in Calcutta statements defamatory of B. B may sue A either in Calcutta or in Delhi.
