Summary

Once a lawsuit has been properly filed in court, the court can send a legal notice called a summons to the person being sued. This summons tells the defendant to appear in court and respond to the claim. The summons must be delivered in the way the law requires, and the date for appearing cannot be more than 30 days after the lawsuit was first filed.

Where a suit has been duly instituted, a summons may be issued to the defendant to appear and answer the claim and may be served in manner prescribed on such day not beyond thirty days from date of the institution of the suit.
