CPC Section 53 — Liability of ancestral property

Summary

Under this section, if a Hindu son or other descendant inherits property that, according to Hindu law, can be used to pay a debt of a deceased ancestor, and a court has already passed a decree for that debt, then that property is treated as if it came to the son or descendant as the legal representative of the deceased. This means the property can be used to satisfy the decree in the same way as property that directly belonged to the deceased.

For the purposes of section 50 and section 52, property in the hands of a son or other descendant which is liable under Hindu law for the payment of the debt of a deceased ancestor, in respect of which a decree has been passed, shall be deemed to be property of the deceased which has come to the hands of the son or other descendant as his legal representative.
