CPC Section 99 — No decree to be reversed or modified for error or irregularity not affecting merits or jurisdiction

Summary

A court hearing an appeal cannot overturn or change a trial court's final order, nor send the case back for a new trial, just because of a mistake in adding or leaving out parties or legal claims, or because of any other error or irregularity in the court proceedings. This protection applies only if the mistake did not affect the actual outcome of the case or the court's authority to hear it. However, this rule does not apply if a person who was essential to the case was left out.

No decree shall be reversed or substantially varied, nor shall any case be remanded, in appeal on account of any misjoinder or non-joinder of parties or causes of action or any error, defect or irregularity in any proceedings in the suit, not affecting the merits of the case or the jurisdiction of the Court :

Provided that nothing in this section shall apply to non-joinder of a necessary party.
