Summary

Before taking their seat, every member of a State Legislative Assembly or Legislative Council must take an oath or make an affirmation. This must be done in front of the Governor or someone the Governor appoints for this purpose. The exact form of the oath or affirmation is provided in the Third Schedule of the Constitution.

Every member of the Legislative Assembly or the Legislative Council of a State shall, before taking his seat, make and subscribe before the Governor, or some person appointed in that behalf by him, an oath or affirmation according to the form set out for the purpose in the Third Schedule.
