IEA Section 28 — Confession made after removal of impression caused by inducement, threat or promise relevant

Summary

If a confession was originally influenced by an inducement, threat, or promise, it can still be considered as evidence in court if the judge believes that the influence has completely disappeared by the time the confession is made. The court must decide that the person's mind is no longer affected by that earlier pressure.

If such a confession as is referred to in section 24 is made after the impression caused by any such inducement, threat or promise has, in the opinion of the Court, been fully removed, it is relevant.
