IPC Section 459 — Grievous hurt caused whilst committing lurking house-trespass or house-breaking

Summary

If a person causes serious injury to someone while secretly entering a house or breaking into a house, or tries to cause death or serious injury during that act, they can be punished with life imprisonment or up to ten years in prison, and may also have to pay a fine.

Official Text

Whoever, whilst committing lurking house-trespass or house-breaking, causes grievous hurt to any person or attempts to cause death or grievous hurt to any person, shall be punished with imprisonment for life, or imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.
