Summary

As between the principal and third persons, any person may become an agent. This means that, in dealings with outsiders, there is no restriction on who can act as an agent.

However, a person who is not of the age of majority and not of sound mind cannot become an agent in a way that makes them responsible to their principal according to the provisions of this Act. In other words, such a person cannot be held liable to the principal in the manner the Act provides.

As between the principal and third persons, any person may become an agent, but no person who is not of the age of majority and of sound mind can become an agent, so as to be responsible to his principal according to the provisions in that behalf herein contained.
