Information Technology Act Section 29 — Access to computers and data
CHAPTER VI REGULATION OF CERTIFYING AUTHORITIES
Cyber Law
Summary
Sub-section (1) allows the Controller, or someone authorised by the Controller, to access any computer system, apparatus, data, or other connected material if there is reasonable cause to suspect that a contravention of the provisions of this Chapter has been committed. This access is for the purpose of searching, or causing a search to be made, to obtain any information or data contained in or available to that computer system. This power operates without prejudice to the provisions of sub-section (1) of section 69, meaning it does not override or limit what that other provision allows.
Sub-section (2) states that for the purposes of sub-section (1), the Controller or any authorised person may issue an order directing any person who is in charge of, or otherwise concerned with the operation of, the computer system, data, apparatus, or material to provide reasonable technical and other assistance as the Controller or authorised person considers necessary.
