Information Technology Act Section 45 — Residuary penalty

Summary

A person who breaks any rule or regulation made under this Act, where no separate penalty is already specified for that particular breach, must pay compensation of up to twenty-five thousand rupees to the person harmed by the breach, or pay a penalty of up to twenty-five thousand rupees.

Official Text

Whoever contravenes any rules or regulations made under this Act, for the contravention of which no penalty has been separately provided, shall be liable to pay a compensation not exceeding twenty-five thousand rupees to the person affected by such contravention or a penalty not exceeding twenty-five thousand rupees.
