CHAPTER VII CONSTRUCTION, EQUIPMENT AND MAINTENANCE OF MOTOR VEHICLES

Summary

Sub-section (1) gives the State Government the power to make rules about how motor vehicles and trailers are built, equipped, and maintained. This power covers all such matters except for those that are already specified in sub-section (1) of section 110.

Sub-section (2) clarifies that the general power in sub-section (1) is broad, and rules may be made on any of the following matters. These rules can apply to all motor vehicles or trailers generally, or only to a particular class or description of them, or only in particular circumstances.

Under clause (a), rules may govern seating arrangements in public service vehicles and how passengers are protected against the weather.

Under clause (b), rules may prohibit or restrict the use of audible signals, such as horns, at certain times or in certain places.

Under clause (c), rules may prohibit the carrying of appliances that are likely to cause annoyance or danger.

Under clause (d), rules may provide for the periodical testing and inspection of vehicles by prescribed authorities, and also for the fees to be charged for such tests.

Under clause (e), rules may specify what particulars, other than registration marks, must be exhibited by vehicles and the manner in which they must be exhibited.

Under clause (f), rules may govern the use of trailers with motor vehicles.

(1) A State Government may make rules regulating the construction, equipment and maintenance of motor vehicles and trailers with respect to all matters other than the matters specified in sub-section (1) of section 110.

(2) Without prejudice to the generality of the foregoing power, rules may be made under this section governing all or any of the following matters either generally in respect of motor vehicles or trailers or in respect of motor vehicles or trailers of a particular class or description or in particular circumstances, namely:—

(a) seating arrangements in public service vehicles and the protection of passengers against the weather;

(b) prohibiting or restricting the use of audible signals at certain times or in certain places;

(c) prohibiting the carrying of appliances likely to cause annoyance or danger;

(d) the periodical testing and inspection of vehicles by prescribed authorities 1[and fees to be charged for such test];

(e) the particulars other than registration marks to be exhibited by vehicles and the manner in which they shall be exhibited;
