Motor Vehicles Act Section 168 — Award of the Claims Tribunal

CHAPTER XII CLAIMS TRIBUNALS

Civil

Summary

Sub-section (1) states that once the Claims Tribunal receives an application for compensation under section 166, it must give notice to the insurer and give all parties, including the insurer, a chance to be heard. The Tribunal will then hold an inquiry into the claim or claims and, subject to the provisions of section 163, may make an award determining the amount of compensation that appears to it to be just. The award must specify who is to receive the compensation, and it must also specify the amount to be paid by the insurer, owner, or driver of the vehicle involved in the accident, or by all or any of them, as the case may be.

Sub-section (2) requires the Claims Tribunal to arrange for copies of the award to be delivered to the parties concerned quickly, and in any case within fifteen days from the date of the award.

Sub-section (3) states that when an award is made under this section, the person required to pay any amount under the award must deposit the entire amount awarded within thirty days of the date the award is announced by the Claims Tribunal, in the manner directed by the Tribunal.
