As the section puts it: “shall be punishable with imprisonment for a term which may extend to three months, or with fine of five thousand rupees, or with both”
Summary
Whoever drives a motor vehicle in violation of section 3 or section 4 of this Act can be punished with imprisonment for up to three months, or a fine of five thousand rupees, or both.

Whoever, drives a motor vehicle in contravention of section 3 or section 4 shall be punishable with imprisonment for a term which may extend to three months, or with fine 4[of five thousand rupees], or with both.
