Summary
Sub-section (1) allows the Central Government to create a National Road Safety Council for the whole country. This is done through an official notification, and the Council will have a Chairman and any other members the Central Government thinks are needed. The Central Government also decides the terms and conditions for these members.
Sub-section (2) gives each State Government the power to create a State Road Safety Council for its own state. This is also done through an official notification, and the Council will have a Chairman and other members chosen by that State Government, with terms and conditions set by that Government.
Sub-section (3) allows a State Government to create a District Road Safety Committee for each district within the state, again through an official notification. Each Committee will have a Chairman and other members as decided by the State Government, along with terms and conditions set by that Government. However, there is a condition: if a State Government has not created a District Road Safety Committee, then the Central Government can step in and create a Committee for that district instead, with its own Chairman and members, and set the terms and conditions for them.
Sub-section (4) states that the Councils and Committees mentioned in this section will carry out functions related to road safety programmes. The specific functions are decided by the Central Government or the State Government, depending on which one is relevant, and these functions are set with regard to the objectives of the Act.
Official Text
(1) The Central Government may, by notification in the Official Gazette, constitute for the country a National Road Safety Council consisting of a Chairman and such other members as that Government considers necessary and on such terms and conditions as that Government may determine.
(2) A State Government may, by notification in the Official Gazette, constitute for the State a State Road Safety Council consisting of a Chairman and such other members as that Government considers necessary and on such terms and conditions as that Government may determine.
(3) A State Government may, by notification in the Official Gazette, constitute District Road Safety Committee for each district in the State consisting of a Chairman and such other members as that Government considers necessary and on such terms and conditions as that Government may determine. 1[Provided that where a State Government has not constituted the District Road Safety Committee, the Central Government may, by notification in the Official Gazette, constitute a Committee for such District, consisting of a Chairman and such other members as it considers necessary and on such terms and conditions as it may determine.]
(4) The Councils and Committees referred to in this section shall discharge such functions relating to the road safety programmes as the Central Government or the State Government, as the case may be, may, having regard to the objects of the Act, specify. 2
