Summary
Sub-section (1) allows the Central Government to create a scheme, through a notification in the Official Gazette, to regulate the business of renting motor cabs or motor cycles to people who want to drive them themselves or hire drivers for their own use, along with related matters.
Sub-section (2) says that such a scheme may cover any or all of the following matters:
Under clause (a), the scheme may provide for licensing of operators, including how licences are granted, renewed, and revoked.
Under clause (b), it may specify the form of application and the form of licences, along with the details that must be included in them.
Under clause (c), it may set the fee that must be paid with the application for such licences.
Under clause (d), it may identify the authorities to which applications should be made.
Under clause (e), it may lay down the conditions under which licences can be granted, renewed, or revoked.
Under clause (f), it may provide for appeals against orders that refuse to grant or renew licences, and appeals against orders that revoke licences.
Under clause (g), it may set the conditions under which motor cabs may be rented.
Under clause (h), it may require the maintenance of records and allow for inspection of those records.
Under clause (i), it may cover any other matters needed to carry out the purposes of this section.
Official Text
(1) The Central Government may, by notification in the Official Gazette, make a scheme for the purpose of regulating the business of renting of 2[motor cabs or motor cycles to persons desiring to drive either by themselves or through drivers, motor cabs or motor cycles] for their own use and for matters connected therewith.
(2) A scheme made under sub-section (1) may provide for all or any of the following matters, namely:—
(a) licensing of operators under the scheme including grant, renewal and revocation of such licences;
(b) form of application and form of licences and the particulars to be contained therein;
(c) fee to be paid with the application for such licences;
(d) the authorities to which the application shall be made;
(e) condition subject to which such licences may be granted, renewed or revoked;
(f) appeals against orders of refusal to grant or renew such licences and appeals against orders revoking such licences;
(g) conditions subject to which motor cabs may be rented;
(h) maintenance of records and inspection of such records;
(i) such other matters as may be necessary to carry out the purposes of this section.
