Summary

Any contract for carrying a passenger in a transport vehicle that has a permit or licence issued under this Chapter is void to the extent that it tries to remove or limit the liability of any person for a claim related to the death of, or bodily injury to, the passenger while being carried in, entering, or alighting from the vehicle. It is also void if the contract tries to impose any conditions on how such a liability can be enforced. In simple terms, such contracts cannot be used to escape responsibility for passenger injuries or death.

Any contract for the conveyance of a passenger in a 2[transport vehicle, in respect of which a permit or licence] has been issued under this Chapter, shall, so far as it purports to negative or restrict the liability of any person in respect of any claim made against that person in respect of the death of, or bodily injury to, the passenger while being carried in, entering or alighting from the vehicle, or purports to impose any conditions with respect to the enforcement of any such liability, be void.
