Summary

In a court case about a cheque or other negotiable instrument that has been dishonoured, if the official protest document is shown as proof, the court will assume the instrument was indeed dishonoured. This assumption stands unless the other side provides evidence to prove that the dishonour did not actually happen.

Ina suit upon an instrument which has been dishonoured, the Court shall, on proof of the protest, presume the fact of dishonour, unless and until such fact is disproved.
