POSH Act Section 17 — Penalty for publication or making known contents of complaint and inquiry proceedings

Summary

Any person who has been given the responsibility to handle or deal with a complaint, the inquiry into it, or any recommendations or actions taken under this Act, and who violates the rules of section 16 (which prohibit disclosing the contents of the complaint or inquiry proceedings), will face a penalty. That penalty will be decided according to the service rules that apply to that person, or if no such service rules exist, it will be imposed in the manner that has been prescribed.

Where any person entrusted with the duty to handle or deal with the complaint, inquiry or any recommendations or action to be taken under the provisions of this Act, contravenes the provisions of section 16, he shall be liable for penalty in accordance with the provisions of the service rules applicable to the said person or where no such service rules exist, in such manner as may be prescribed.
