Sale of Goods Act Section 28 — Sale by one of joint owners
CHAPTER III EFFECTS OF THE CONTRACT — Transfer of title
Commercial / Corporate
Summary
If one of several joint owners of goods is the only one holding them, and the other co-owners have allowed that person to have sole possession, then a buyer who purchases the goods from that joint owner in good faith will get ownership of the goods. This applies as long as the buyer, at the time of making the contract of sale, has no notice that the seller lacks the authority to sell.
