Summary

An unpaid seller who has delivered only part of the goods can still hold a lien—that is, a right to keep possession—over the goods that remain undelivered. This right applies unless the way the part delivery was made indicates that the seller agreed to give up that lien on the remaining goods.

Where an unpaid seller has made part delivery of the goods, he may exercise his right of lien on the remainder, unless such part delivery has been made under such circumstances as to show an agreement to waive the lien.
