General

Summary

To give away immovable property, like land or a house, the transfer must be done through a registered document that is signed by the person giving the gift (or someone acting on their behalf) and witnessed by at least two people. To give away movable property, like furniture or a car, the gift can be made either through a similar registered document or simply by physically handing the item over. The physical delivery of the movable item can be done in the same manner as delivering goods that have been sold.

For the purpose of making a gift of immoveable property, the transfer must be effected by a registered instrument signed by or on behalf of the donor, and attested by at least two witnesses. For the purpose of making a gift of moveable property, the transfer may be effected either by a registered instrument signed as aforesaid or by delivery. Such delivery may be made in the same way as goods sold may be delivered.
