Transfer of Property Act Section 16 — Transfer to take effect on failure of prior interest

General
Summary
If a gift or interest given to someone (or a group) fails because it breaks the rules in sections 13 and 14, then any later gift in the same transaction that was meant to start only after that first gift failed will also fail. In other words, if the first part of a transfer is invalid, the follow-up part that depends on it cannot stand on its own.

Where, by reason of any of the rules contained in sections 13 and 14, an interest created for the benefit of a person or of a class of persons fails in regard to such person or the whole of such class, any interest created in the same transaction and intended to take effect after or upon failure of such prior interest also fails.
