Transfer of Property Act Section 32 — Such condition must not be invalid

Summary

For a condition that ends a person’s interest in property to be valid, the event that triggers the end must be something that could legally be used as a condition for creating an interest in the first place. In other words, the law will not allow a condition to stop an interest if that same condition would be illegal or invalid as a condition for starting an interest.

In order that a condition that an interest shall cease to exist may be valid, it is necessary that the event to which it relates be one which could legally constitute the condition of the creation of an interest.
