Summary

If a person has given two or more mortgages to the same lender, and the money for any two or more of those mortgages is due, that person has the right to pay off and redeem any one mortgage on its own, or pay off and redeem two or more of them together. This right applies unless there is a specific agreement saying otherwise.

A mortgagor who has executed two or more mortgages in favour of the same mortgagee shall, in the absence of a contract to the contrary, when the principal money of any two or more of the mortgages has become due, be entitled to redeem any one such mortgage separately, or any two or more of such mortgages together.]
