Transfer of Property Act Section 91 — Persons who may sue for redemption
CHAPTER IV OF MORTGAGES OF IMMOVEABLE PROPERTY AND CHARGES — Redemption
General
Summary
Besides the mortgagor, the law allows certain other people to redeem the mortgaged property or file a suit to redeem it. These include anyone with an interest in or charge on the property or on the right to redeem it, except the mortgagee of that interest. A surety who guaranteed payment of the mortgage debt, or any part of it, can also redeem. Additionally, a creditor of the mortgagor who has obtained a court decree for the sale of the mortgaged property in an administration suit is allowed to redeem.
