BNSS Section 85 — Attachment of property of person absconding

CHAPTER VI PROCESSES TO COMPEL APPEARANCE — C.—Proclamation and attachment

Criminal

Summary

After a court issues a public notice asking a person to appear, it can also order that the person’s property be taken under its control. The court must write down its reasons for doing so. If the court believes the person is about to sell or remove their property from the court’s area, it can order the attachment at the same time as the notice is issued. The attachment order applies to property within the district where the order is made, and also to property in other districts if the local District Magistrate approves it. For movable property like debts, the court can seize it, appoint a receiver, or forbid anyone from giving it to the person. For immovable property like land, the attachment is done through the district Collector for revenue-paying land, or by taking possession, appointing a receiver, or forbidding rent payments. If the property is livestock or perishable goods, the court can order an immediate sale, and the money from the sale will be held until the court decides what to do with it. A receiver appointed under this section has the same powers and duties as a receiver under the Code of Civil Procedure.
