BSA Section 87 — Presumption as to Electronic Signature Certificates

Summary

The Court must assume that the information listed in an Electronic Signature Certificate is correct, unless someone proves otherwise. This assumption applies only if the certificate was accepted by the subscriber, meaning the person to whom the certificate belongs.

However, this presumption does not apply to information that is specifically marked as subscriber information which has not been verified. For that unverified subscriber information, the Court does not presume it is correct.

The Court shall presume, unless contrary is proved, that the information listed in an Electronic Signature Certificate is correct, except for information specified as subscriber information which has not been verified, if the certificate was accepted by the subscriber.
