Summary

If a vacancy arises in the office of the President or a member of a District Commission, the State Government can step in to manage the situation. It may issue a formal notification to address the gap.

Under clause (a) of this section, the State Government can direct another District Commission, named in the notification, to also handle cases and matters for the district that has the vacancy. This means the other commission will exercise jurisdiction over that district as well.

Under clause (b) of this section, the State Government can instead direct the President or a member of another District Commission, named in the notification, to also carry out the powers and duties of the vacant position in the affected District Commission. This allows a person from a different commission to temporarily take on the responsibilities of the missing officer.

If, at any time, there is a vacancy in the office of the President or member of a District Commission, the State Government may, by notification, direct—

(a) any other District Commission specified in that notification to exercise the jurisdiction in respect of that district also; or

(b) the President or a member of any other District Commission specified in that notification to exercise the powers and discharge the functions of the President or member of that District Commission also.
