Summary
Sub-section (1) requires every State Government to set up a State Consumer Protection Council for that state, called the State Council, through an official notification. The council comes into effect from the date specified in that notification.
Sub-section (2) states that the State Council is an advisory body, meaning it only gives advice and does not have decision-making powers. Its members include the Minister in charge of Consumer Affairs in the State Government, who serves as the Chairperson, along with other official or non-official members representing various interests as may be prescribed, and up to ten additional official or non-official members nominated by the Central Government.
Under clause (a) of sub-section (2), the Chairperson of the State Council is the Minister responsible for Consumer Affairs in the State Government.
Under clause (b) of sub-section (2), the State Council includes such number of other official or non-official members representing interests as may be prescribed, meaning the exact number and interests are set by rules.
Under clause (c) of sub-section (2), the State Council also includes other official or non-official members, not exceeding ten, who are nominated by the Central Government.
Sub-section (3) requires the State Council to meet as and when necessary, but it must hold at least two meetings every year.
Sub-section (4) states that the State Council meets at such time and place as the Chairperson decides, and it must follow the procedure for conducting its business as may be prescribed.
Official Text
(1) Every State Government shall, by notification, establish with effect from such date as it may specify in such notification, a State Consumer Protection Council for such State to be known as the State Council.
(2) The State Council shall be an advisory council and consist of the following members, namely:—
(a) the Minister-in-charge of Consumer Affairs in the State Government who shall be the Chairperson;
(b) such number of other official or non-official members representing such interests as may be prescribed;
(c) such number of other official or non-official members, not exceeding ten, as may be nominated by the Central Government.
(3) The State Council shall meet as and when necessary but not less than two meetings shall be held every year.
(4) The State Council shall meet at such time and place as the Chairperson may think fit and shall observe such procedure in regard to the transaction of its business, as may be prescribed.
