IPC Section 375 — Rape

sexual offences

Criminal

Summary

A man commits rape if he performs any of the following sexual acts with a woman under any of seven specific circumstances: penetrating his penis into her vagina, mouth, urethra, or anus; inserting any object or body part (other than his penis) into her vagina, urethra, or anus; manipulating any part of her body to cause penetration into her vagina, urethra, anus, or any body part; or applying his mouth to her vagina, anus, or urethra. The seven circumstances are: against her will; without her consent; with consent obtained by putting her or someone she cares about in fear of death or hurt; with consent given because she mistakenly believes he is her husband; with consent given when she is unable to understand the act due to unsoundness of mind, intoxication, or drugs; with or without consent when she is under 18; or when she is unable to communicate consent. Consent means a clear, voluntary agreement shown through words, gestures, or any communication that she is willing to participate in that specific sexual act, and lack of physical resistance alone does not count as consent. Medical procedures are not rape, and sexual acts by a man with his own wife are not rape if she is at least 15 years old.
