Summary

If a person is convicted of an offence that can be punished by both imprisonment and a fine, and the court decides to impose only a fine (with or without imprisonment), the court may also order imprisonment if the fine is not paid. The same applies if the offence is punishable by either imprisonment or a fine, or by a fine alone, and the court chooses to impose a fine.

In every case of an offence punishable with imprisonment as well as fine, in which the offender is sentenced to a fine, whether with or without imprisonment, and in every case of an offence punishable with imprisonment or fine, or with fine only, in which the offender is sentenced to a fine.
