Tamil Nadu Prohibition Act Section 2 — Repeals
Criminal
Summary
From the date the main provisions of this Act (everything except Sections 1, 3 and 6) take effect in any local area, the older laws listed in Schedule I stop operating in that area, but only to the extent shown in the fourth column of that Schedule.
However, the State Government may issue a notification declaring that the main provisions of this Act (again, everything except Sections 1, 3 and 6) will stop operating in any local area on a date specified in that notification. When that happens, the older laws listed in Schedule I, along with any later amendments to them, come back into force in that area from that date.
For clarity, if such a notification is issued for any area that was formerly part of the State of Pudukottai, the older laws listed in Schedule I, along with any later amendments, come into force in that area from the date specified in the notification.
Official Text
From the date on which the provisions of this Act other than Sections 1, 3 and 6 come in to force in any local area, the enactments mentioned in Schedule I shall cease to be in force in such area to the extent specified in the fourth column thereof:
Provided that the State Government may, by notification, declare that the provisions of this Act other than Sections 1, 3 and 6 shall cease to be in force in any local area on such dates as may be specified in the notification and thereupon the enactments mentioned in Schedule I with any subsequent statutory modifications thereof shall revive and come into force in such area with effect on and from such date.
Explanation -- For the removal of doubts, it is hereby declared that if a notification is issued in pursuance of the foregoing proviso, in respect of any area which formerly formed part of the State of Pudukottai the enactments mentioned in Schedule I with any subsequent statutory modifications thereof come into force into such area with effect on and from such date as may be specified in the notification.
