Tamil Nadu Prohibition Act Section 30 — Power of entry and inspection

Summary

The Collector, any Prohibition Officer of a rank the State Government decides, or any police or other paid or honorary officer authorised by the State Government for this purpose, may enter and inspect any place at any time, day or night, if there is reasonable suspicion of certain things.

Under clause (a), the suspicion may be that toddy is being drawn, or that the manufacture of any other liquor or of any intoxicating drug is being carried on in that place.

Under clause (b), the suspicion may be that any liquor or intoxicating drug is kept for sale or stored in that place.

Under clause (c), the suspicion may be that an offence under section 5 has been, or is being, committed in that place.

When entering and inspecting such a place, the authorised officer may examine, test, measure, or weigh any material, still, utensil, implement, apparatus, liquor, or intoxicating drug found there.

The Collector, any Prohibition Officer not below such rank as the State Government may determine or any police or other paid or honorary officer authorised by the State Government in this behalf, may enter and inspect at any time by day or by night, any place in which it is reasonable suspected---

(a) that any toddy is drawn, or the manufacture of any other liquor or of any intoxicating drug is carried on ; or

(b) that any liquor or intoxicating drug is kept for sale or stored ; or

(c) that an offence under [****] section 5 has been, or is being committed; and may examine, test, measure or weigh any material still, utensil, implement , apparatus, liquor or intoxicating drug found in such place.]
