Tamil Nadu Prohibition Act Section 42 — Power of Police or Prohibition Officer to summon witnesses

Summary

Any Police or Prohibition Officer who is holding an inquiry in the manner provided in section 38 may summon any person to appear before the officer to give evidence in that inquiry, or to produce any document relevant to the inquiry that the person has in their possession or under their control.

However, the officer cannot summon a person to appear if the journey required to comply with the summons exceeds ten miles by road, or fifty miles by rail, or any other limit that the State Government may fix.

Any Police or Prohibition Officer holding an inquiry in the manner provided in section 38 may summon any person to appear before himself to give evidence on such inquiry or to produce any document relevant thereto which may be in his possession or under his control:

Provided that no such officer shall so summon any person to appear before him if the journey to be made for complying with such summons exceeds ten miles by road or fifty miles by rail or such other limits as the [State] Government may fix.
