Any officer or person exercising powers under this Act who vexatiously and unnecessarily delays forwarding to a Prohibition Officer or to the officer-in-charge of the nearest police station, as required by Section 38, any person arrested or any articles seized under this Act, shall be punished with a fine which may extend to two hundred rupees.
