Tamil Nadu Prohibition Act Section 10 — Punishment for abetment of escape of person arrested, etc

Summary
This section deals with punishment for officers who misuse their powers under this Act. It applies to any officer or person exercising powers under this Act.
Under clause (a), if such an officer or person unlawfully releases a person arrested under this Act, or helps such a person escape, or helps in the commission of any offence against this Act, they are covered by this section.
Under clause (b), if such an officer or person acts in any way that is inconsistent with their duty, with the purpose of enabling anyone to do anything that may lead to the evasion or breaking of any provision of this Act, they are also covered by this section.
The section also covers any other officer of the State Government or of a local body who helps in the commission of any offence against this Act. Any person covered by this section shall be punished with imprisonment which may extend to six months, or with fine which may extend to five hundred rupees, or with both.

Any officer or person exercising powers under this Act who --
(a) unlawfully releases or abets the escape of any person arrested under this Act, or abets the commission of any offence against this Act, or
(b) acts in any manner inconsistent with his duty for the purpose of enabling any persons to be anything whereby any of the provisions of this Act may be evaded or broken, and any other officer of the 3[State] Government or of a local body who abets the commission of any offence against this Act, shall be punished [with [***] imprisonment] which may extend to six months, or with fine which may extend to five hundred rupees, or with both.
