Transfer of Property Act Section 29 — Fulfilment of condition subsequent

Summary

A transfer that is meant to happen only after a certain condition is met will not take effect unless that condition is met exactly as stated. For example, if money is given to someone on the condition that they either reach adulthood or marry with a specific person’s consent, and they marry without that consent while still a minor, the original transfer fails and the money goes to the next person named in the arrangement.

An ulterior disposition of the kind contemplated by the last preceding section cannot take effect unless the condition is strictly fulfilled. Illustration A transfers Rs. 500 to B, to be paid to him on his attaining his majority or marrying, with a proviso that, if B dies a minor or marries without C's consent, the Rs. 500 shall go to D. B marries when only 17 years of age, without C's consent. The transfer to D takes effect.
