Transfer of Property Act Section 30 — Prior disposition not affected by invalidity of ulterior disposition

General

Summary

If a later part of a property transfer is not legally valid, the earlier part of the transfer still stands and is not affected by that invalidity. For example, if a person gives a farm to someone for their lifetime, and then adds a condition about what happens after that, and the condition is not valid, the person still gets the farm for their lifetime just as if the condition had never been included.

If the ulterior disposition is not valid, the prior disposition is not affected by it. Illustration A transfers a farm to B for her life, and, if she do not desert her husband to C. B is entitled to the farm during her life as if no condition had been inserted.
